Terms and Conditions for the Use of this Website

Introduction

This website is owned and operated by Bendon Limited (known together with its directors and employees as “we”, “our” or “us”) a New Zealand registered, and we are the supplier of the goods featured. The use of this website is governed by the policies, terms and conditions (the “terms”) set forth below.

The following terms, conditions, and notices (Site Rules) apply to all visitors or users of this Web site, and of microsites or mobile sites of our brands and lines of business that expressly adopt these Site Rules (collectively, the "website").

You should only access and use this website once you have read, accepted, and agreed to comply with the terms. Your use of this website including for the purposes of placing an order, registering an account or signing up to receive our e-mails is deemed to be your acceptance of the terms. If you do not agree with any of the terms, do not access or use this website.

These terms shall supersede any subsequent terms or conditions included with any purchase order, whether or not those terms or conditions are signed by us.

Payment Methods and Processing

All prices displayed Online at www.bendonlingerie.co.nz are shown in New Zealand Dollars (NZD) and will processed from your chosen method of payment in NZD.

We currently accept company e-Gift Cards, Visa, MasterCard, American Express, and PayPal. Payment processing will not begin until we receive all the information we need. We process all payments after you click the "Place Order" button. For all payments we will e-mail a tax invoice to you with your Order Confirmation. Your tax invoice is your proof of purchase.

  • EziPay is currently not accepted in Australia or for online transactions in New Zealand.

Prices

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of any applicable taxes. Delivery costs will be charged in addition; any applicable charges for delivery are highlighted at checkout.

Bendon Group websites may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on any Bendon Group website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies

Additional taxes, fees or levies may apply according to local legislation. Recipients of deliveries made outside of Australia and New Zealand may have to pay import duty or formal customs entry fees. Any customs or import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. We have no control over these charges and cannot predict what they may be as customs policies and import duties vary from country to country. You may want to contact your local customs office for further information.

Delivery may be delayed by local customs. Unfortunately this is out of our control.

Promotions

  1. Promotions, discounts, offers, multi-buys and promotional codes (collectively "Promotions") are valid for the specified time period for purchases of included product and may only be used once unless otherwise stated.
  2. One time use Promotions must be used in their entirety in a single purchase. Any amounts not redeemed in the applicable purchase will be forfeited. Promotions cannot be combined with other promotions.
  3. Promotions do not apply to sale items, all swim and swimwear products, gift cards, delivery, gift wrapping, GST or duties or similar services, unless otherwise stated.
  4. Promotions cannot be applied retroactively to previously placed orders or to orders that are placed after the Promotion has ended.
  5. For promotions requiring a minimum order value, charges for delivery and/or the cost of the gift with purchase do not count towards the minimum order value requirement.
  6. For promotions where you must buy two (or more) items to get a reduction on the third (additional) item(s), the discount will be applied at checkout to the lowest priced item.
  7. If merchandise was purchased with a Promotion and subsequently returned within 100 days of the date of purchase, you will be issued a credit or refund at the promotional price and, if the Promotion has expired, it cannot then be applied to a replacement or future order.
  8. If merchandise was purchased with a Promotion and subsequently returned within 100 days of the date of purchase, if the customer return results in the spend falling under the offer threshold, the dollar discount will be removed. This will not apply to like for like exchanges.
  9. If you return a gift that was purchased with a Promotion and the Promotion has expired, you cannot apply the expired Promotion to a replacement or future order.
  10. Promotional items are available only while stocks last; Bendon Lingerie do not issue rain checks for items that run out of stock.
  11. Bendon Lingerie can, at its sole discretion, extend or terminate a Promotion at any time.
  12. Bendon Lingerie has no obligation to advise an entrant of an incomplete order and will not be accountable for the return of any item ordered incorrectly.
  13. By claiming a promotional offer on your order, you agree that you have understood the terms and conditions of that promotion.
  14. In store purchases for yellow stickered stock are final and cannot be returned for a refund or exchanges as noted at the register and on the receipt at the time of sale. Items containing a manufacturing fault with a copy of the original receipt are an exception pending assessment by our quality care team.

Sale Events

  1. Sale, Flash Sale, Online Outlet, Mid-season Sale, End of Season Sale (collectively "Sales") are valid for the specified time period for purchases of included product.
  2. To receive Sale pricing you must complete your purchase during the specified time period. Adding products to your shopping cart does not constitute a completed purchase.
  3. A sale item is defined as any merchandise that is not full Reccommended Retail Price (RRP)

Promotional Codes

Promotional codes are only available for use online at any of the website listed above under Bendon Group Websites, unless otherwise stated. To qualify for the promotion you will need to meet the purchase criteria and enter the promotion code at checkout. Each promotional code will have an expiry date by which you will need to redeem the offer. Promotion codes can only be redeemed once per customer and cannot be used in conjunction with any other offer. Promotional codes are applied to the product order value and exclude gift cards, e-gift card, gift wrapping and delivery, unless otherwise stated.

Supply of Your Products

Subject to these terms, we will supply to you the products indicated on your Order Confirmation. When your Order items have been dispatched, we will e-mail you to confirm dispatch of the products in your Order and will include a delivery tracking number for your Order.

Delivery of Your Order

Delivery time varies depending on the delivery address. For specific delivery time frames visit our dedicated Delivery page

We encourage you to visit My Account to view the delivery status of your Order. We use our reasonable efforts to deliver your Order according to the estimated delivery time provided, however, the estimated delivery times may change for reasons including those which are beyond our control. We do not guarantee delivery times and we will not be held accountable for late deliveries or for loss, or damage relating to late deliveries. If your Order has not arrived before the estimated delivery time, please contact us. Title and risk of loss to all orders will pass to you on delivery.

Unless otherwise agreed by us, we will deliver your Order to the delivery address indicated on your Order Confirmation.

The purchase of goods is subject to availability. In the event that multiple items are ordered, part deliveries may be made where stock is not available or stock is on back-order. If stock is on back-order you will be notified of this at the time you add the product to your shopping bag. All reasonable attempts to notify you will be made using the details you provided. Please ensure you enter the correct delivery address. We cannot be held responsible for incorrectly entered delivery addresses.

Acceptance of the Goods

You are responsible for inspecting Your Order for any faults upon receiving Your Order.

Returns, Exchanges and Refunds

We offer returns or exchanges for products that are of an incorrect size, colour, or other fault, as long as the return is received by us within 100 days of the date of purchase, proof of purchase is available, the returned products are in original condition and not worn or soiled.

Returned items must include all packaging, with tags still attached.

When returning an item your refund will be processed via the same payment method that was used for the original purchase.

The estimated delivery time for the replacement product will be the same as stated for the original product.

Change of Address

We cannot be held responsible for an incorrect address being entered on your Order. Address Confirmation is shown on the checkout page and in the Order Confirmation e-mail If this is not noticed until after your Order is finalised, please contact us immediately. We will attempt to update any incorrect order details, however due to the fast turnaround of our warehouse, some orders cannot be adjusted.

Credit Card Fraud

We employ Secure Sockets Layer (SSL) technology software for transactions completed on this website. We will not be responsible for any damages, or consequential losses (whether direct or indirect), suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

Bendon Limited uses the DPS Payment Express and PayFlowPro Payment Gateway's for its online credit card transactions.
Both DPS and PayFlowPro processes online credit card transactions securely for thousands of merchants globally, providing a safe and secure online payment service.

  • Bendon Limited does not have access to your full card number, this credit card payment is secured by DPS and PayFlowPro
  • DPS and PayFlowPro have bank grade security. All transaction details are stored in their PCI-DSS compliant Data Centre

Fraud Protection or Prevention Procedures

When you place your Order by either Credit Card or PayPal you may be sent an e-mail from our Fraud Prevention Officer requesting further information, such as a copy of your credit card and drivers license for identification. These information requests are sent to help protect Credit Card and PayPal account holders from online fraud. After verification, the information you submit will be destroyed. In this case, until your order has passed internal Fraud Prevention procedure checks your order will remain on Pending status. If you do not provide the requested information within 7 calendar days, your order will be cancelled and your payment will be refunded to the payment method you used.

Governing Law

These terms shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the non-exclusive jurisdiction of the courts of New Zealand.

Termination

We may terminate these terms and your access to this website at any time without notice. In the event of termination you are no longer authorised to access the website. All restrictions imposed on you, disclaimers and limitations of liability set out in these terms will survive termination. We reserve the right to withdraw access to this website at any time without notice. You must terminate your link to this website if we request you to do so, either directly or by notice on this website.

By accepting our terms and conditions, consumers give their consent for their IP address to be shared with a third party.
